								<div style=3D"text-align: justify;">On 23 June, three on-duty NGO s=
taff members were briefly detained at a mobile vehicle checkpoint (VCP), ma=
nned by GDI members in the abovementioned area. The NGO staff members were =
on a mission from Jalalabad to Asadabad. Prior to their mission, the NGO st=
aff members notified the provincial GDI NGO focal point of their movement, =
following a GDI directive issued to NGOs on 18 January for the Eastern Regi=
on requiring that NGO official movements be notified. GDI members held the =
NGO personnel for approximately one hour to confirm their identities and mo=
vements. After a short investigation, GDI members were able to confirm the =
identity of the NGO staff members and they were allowed to continue their m=
ission unharmed.</div>								</div>

								<div style=3D"text-align: justify;">Since August 2021, INSO has rec=
orded at least two other incidents involving brief detentions of NGO staff =
members at VCPs in the Eastern Region. These incidents are believed to be c=
ommon in the region, as such, they are considered to be underreported.</div=
>
<div style=3D"text-align: justify;">&nbsp;</div>
<div style=3D"text-align: justify;">In all incidents, NGO staff members had=
 notified provincial authorities prior of their movements but were still de=
tained and investigated with by IEA forces or GDI members. On 23 May in Nan=
garhar Province, Surkhrod District, Shamsha Pur area, two NGO staff member =
were briefly detained by IEA forces at a VCP. IEA authorities stated that t=
he NGO staff members did not notify provincial authorities of their movemen=
t. After a brief investigation, IEA members determined that the NGO had in =
fact notified IEA provincial authorities and subsequently released the NGO =
staff unharmed. Similarly, on 08 June, in Kunar Province, Chapadara DAC, fo=
ur NGO staff members were detained for the same reasons. After an investiga=
tion it was confirmed that their movement had been notified to provincial a=
nd district authorities in advance. These incidents illustrate the effects =
of the IEA&rsquo;s deficient command-and-control structures and unclear pol=
icies between high-ranking IEA authorities and lower ranking IEA members, s=
uch as the ones stationed at VCPs.</div>
<div style=3D"text-align: justify;">&nbsp;</div>
<div style=3D"text-align: justify;">In the incident from 23 June, VCP GDI m=
embers repeatedly told the NGO staff members that they must check with thei=
r commanding officer whether the NGO had a clearance. NGO staff members men=
tioned the name and department of the GDI NGO liaison officer that they had=
 notified 48 hours prior to their mission. The GDI members stated that he w=
as not their commanding officer, and they are obliged to communicate with t=
heir headquarter commander. This response suggests not only a lack of coord=
ination between higher level staff of the same institution, but also the fa=
ct that messages are rarely passed down to checkpoint levels. As such, even=
 if NGOs abide by the IEA directives, this will not necessarily allow acces=
s on the ground. &nbsp;The GDI&rsquo;s directive is in itself not universal=
ly enforced, and runs against Article 46 of the NGO Law, which requires sec=
urity forces to refer to the Ministry of Economy for any information concer=
ning NGOs.</div>
<div style=3D"text-align: justify;">&nbsp;</div>
<div style=3D"text-align: justify;">Even though such incidents did not conc=
lude, as of yet, with the death or injury of NGO staff members, it does neg=
atively impact NGO programming activities. Moreover, such incidents place a=
n unecessary burden on NGO staff members. These burdens can cause unnecessa=
ry anxiety and psychological pressure, due to the high intensity of questio=
ning by security forces.</div>
<div style=3D"text-align: justify;">&nbsp;</div>
<div style=3D"text-align: justify;">As stated above, incidents similar to t=
hese are underreported due to their resolution in a quick manner with no ph=
ysical harm to NGO staff members. Nonetheless, until a sustainable coordina=
tion mechanism is created between GDI or other IEA authorities vis-&agrave;=
-vis NGO notification of movements, such incidents are likely to continue i=
n the foreseeable future.</div>								</div>

o hold and carry appropriate identification and approval documents while on=
 duty, to and from work, and to be ready to justify their presence within t=
he area of operations to IEA authorities.</div>

<div style=3D"text-align: justify;">NGO should continue to engage with IEA =
officials and advocate that while humanitarian actors require the consent o=
f the authorities for the delivery of aid, this consent cannot be offered a=
t the expense of the humanitarian principles as well as in breach of the NG=
O Law.</div>

<div style=3D"text-align: justify;">NGO security focal points are advised t=
o maintain a good relationship with local actors, community leaders and sec=
urity forces, and ensure that contact details are available for possible de=
